Apply for the establishment of sales events such as weekly, annual or special markets

If you as an organizer want to organize a fair, an exhibition, a wholesale market, a weekly market, a fair or a special market (for example a Christmas market), a permit for the event is required.

  • Detailed description

    In the context of the approval procedure, weekly, annual and special markets are considered to be events.

    • A weekly market is a regularly recurring, time-limited event at which a large number of vendors offer, for example, food and raw natural products.
    • A special market is one where specific goods are usually offered at regular intervals for a limited period of time.
    • All kinds of goods are offered at fairs. In general, fairs are events that recur regularly at longer intervals and are limited in time.
    • If you, as an organizer, want to offer a weekly, annual or special market, you must apply for a determination (permit) from the competent authority. The permit means that you as an organizer are exempt from some commercial obligations (for example, travel tissue map, compliance with store closing times).
    • Organizers are natural persons and legal entities. Cities also often act as organizers, mainly in the case of weekly markets. If the market takes place in public space, a special use permit is required. In the application procedure, the competent authority checks the reliability of the applicant.
  • Requirements

    In order for you to be approved for the event, you must

    • Prove your personal reliability and the reliability of the persons entrusted with the management of the event. This is checked on the basis of excerpts from the Federal Central Register and the Central Trade Register.
    • In addition, protection against danger to life and health must be ensured for the participants.
    • The event must not pose a threat to public safety and order.
  • Documents
    • Certificate of good conduct
    • Extract from the Central Trade Register
    • Certificate in tax matters from the tax office of the place in which you have resided or operated a business in the past 3 years
    • Negative certificate from the insolvency court of the local court in whose district you have had a residence or a commercial establishment in the past 3 years

    • Special use permit
  • Fees

    The costs are based on the respective administrative fee regulations of the state or on the fee statutes of the bodies responsible under state law.

    Supplement to the State of Brandenburg:

    The costs for the scheduling of an event are as follows: 2.3.1 of the Ordinance on Administrative Fees in the Portfolio of the Minister of Economy, Labour and Energy € 56.00 – € 2,267.00.

  • Process

    If you have submitted the application informally and all documents are complete, the competent body will check whether you meet all the requirements for granting the requested fixing of an event.

    • Information that the informal application must contain:
      • Event date
      • Location
      • Opening hours
      • Event name, for example "Spring Market
      • Site plan with stands, bird's eye view of access roads
      • Preliminary list of participants with range of goods offered by participants
      • Blank contract concluded between organizer and traders
    • If you meet all the requirements, approval will be granted.
  • Duration

    As a rule, you will receive a decision within 3 months, as long as there are no regulations under state law.

  • Deadline

    The application and all supporting documents must be received by the relevant authority in good time before the start of the event.

  • Responsible authority

    The district regulatory authorities are responsible for determining a trade fair (Section 64 GewO), exhibition (Section 65 GewO) or a wholesale market (Section 68 GewO).

    The trade offices of the local authorities, independent municipalities, association municipalities, co-administrating municipalities, co-administered municipalities and independent cities are responsible for the establishment of a weekly market (Section 67 GewO), special market (Section 68 (1) GewO) or annual market (Section 68 (2) GewO).
