Detailed description
By means of a written declaration to the lower building supervisory authority, a property owner can submit obligations under public law to do or omit an act or omission concerning his or her property (e.g. takeover of distance or parking spaces, association of land). The declaration is entered as a building encumbrance in the list of building encumbrances.
Anyone who demonstrates a legitimate interest can inspect this list or have copies made.

Process
An informal application must be submitted to the locally competent lower building supervisory authority. In the case of a legitimate interest, the register can be inspected or copies can be made.

Until the introduction of the building encumbrances in 2016, the legal protection of obligations was carried out by means of limited personal easements, which continue to be valid. For complete information on obligations on a property, it is therefore advisable to inspect the land register.

Publicly appointed surveyors and notaries are authorised to inspect by virtue of their profession and do not need to demonstrate their legitimate interest.
