    If new buildings are to be erected, changes are made to buildings or a change of use is to take place, a building permit is usually required.

  • Requirements

    Please submit the building application in triplicate in paper form and also as an electronic copy. If the lower building supervisory authority has opened electronic access, it must be used. For your building application, you must use the prescribed forms.

    For most building applications, the preparation of the building templates and a signature by a person authorized to submit building documents (design author) is required.

    If the building plot is located in a development plan area, a building notification or a simplified building permit procedure may be sufficient.

    In addition to the application form, the following documents must also be submitted:

    • Construction drawings
    • Specifications
    • official site plan
  • Fees

    1.4 percent of the eligible construction value, at least €100

    According to subheading 1.1-1.5 of the Brandenburg Building Fee Regulations

    The fee may be partially charged as an advance.

  • Process

    In the building permit procedure, the project will be examined in its entirety. Within two weeks of receipt of the application, the lower building supervisory authority checks whether the building templates are complete and confirms receipt.

    If the building templates are incomplete or defective, the client will be informed of a deadline for supplementing the building application with the confirmation of receipt.  

    The application shall be deemed to have been withdrawn if the missing documents are not submitted in due time (Section 69 (2) BbgBO).

    If the building templates are complete, the lower building supervisory authority immediately involves all specialist authorities whose interests are affected by the project, as well as the municipality. The deadline for the specialist authorities to comment is one month, and the municipality has two months to issue the municipal consent.

    If all comments have been received and there are no contradictions with public law regulations, the building permit must be granted. The building permit includes all necessary permits.

  • Duration

    After receipt of the comments, the lower building supervisory authority is granted a statutory decision period of one month in Section 69 (6) BbgBO, so that the building permit procedure is usually completed after four months.

  • Deadline

    The period of validity of the building permit is six years in accordance with § 73 BbgBO.

    The building permit and the partial building permit do not expire if the execution of the construction project has begun within six years of the granting of the permit and the commencement of use has been notified no later than one year after the expiry of the period.

    An extension of the period of validity is not possible.
