Application procedure and significance of a certificate of first refusal
The municipality has a statutory right of first refusal. This gives it the opportunity to force the buyer out of the contract and to take his place itself in order to ensure orderly urban development in the long term.
In the context of land and real estate purchase transactions, it is often necessary to apply for a certificate from the municipality in whose area of application the object of purchase is located as to whether there is a right of first refusal and, if so, whether this is exercised. If the municipality does not make use of its right (as a rule), a negative attestation subject to a fee will be issued.
