Funeral Execution Forced burial

If no one takes care of the funeral of a deceased person, the local regulatory authority arranges for it at the expense of the person obliged to be buried or at the expense of the heir.

  • Detailed description

    An orderly funeral takes place if no relatives of the deceased are present or can be identified, no provision has been made for the funeral and no one else is responsible for the funeral.

    The local regulatory authorities (offices, unincorporated municipalities, association municipalities, co-administered, co-administering municipalities and independent cities) of the place of death are responsible.

    The funeral is carried out at the expense of the person obliged to be buried. Who this is can be found in § 20 paragraph 1 of the Brandenburg Funeral Act. In addition, the heir of the deceased person is obliged to pay for the funeral.

    In principle, the funeral must be carried out in accordance with the will of the deceased person. If this will is not known, a local burial must be carried out. In practice, in these cases, the ashes of the dead are usually buried in an urn community grave. In this case, the scattering of the ashes of the dead on an ash litter meadow or burial at sea is not permitted.

    • notarization of the death,
    • Expiry of the waiting period,
    • Presence of a grave site.
  • Fees

    At a minimum, there are costs for:

    • the performance of the post-mortem examinations,
    • the notarizations,
    • cremation,
    • the right to use the grave ("acquisition" of the grave site),
    • the coffin,
    • the urn,
    • Administrative costs
    • possibly funeral homes.

    The amount of the costs depends on the type of burial.

  • Process

    The local regulatory authority may also make use of a funeral home.

  • Deadline

    The burial or cremation must be carried out within 10 days of the discovery of death.
