  • Detailed description

    Permission to operate an arcade or similar companies in accordance with § 33i of the Industrial Code (GewO) as well as permission for the construction and operation of an arcade in accordance with § 2 of the Brandenburg Gambling Hall Act (BbgSpielhG).

    Anyone wishing to operate an arcade or similar business on a commercial basis which serves exclusively or predominantly the installation of gaming equipment or the organisation of other games within the meaning of § 33c (1) sentence 1 or § 33d (1) sentence 1 GewO requires the respective permit of the respective competent authority.

  • Requirements

    Regulated in § 33i of the Industrial Code and in the Brandenburg Gambling Hall Act:

    • Application of a natural person
    • Application form (completed and signed)
    • Certificate of good conduct and information from the Central Trade Register for submission to a
    • Authority (GZR) document type "O"
    • This information can be obtained from the residents' registration office responsible for the place of residence at
    • 0401-III-3214-09 03/A and must not be older than three months.
    • Information on entries in the debtor register until 31.12.2012 (§ 915a ZPO old law)
    • To be applied for at the district court of the place of residence and/or commercial establishment at that time.
    • Information on entries in the Central Register of Debtors of the Central Enforcement Court

    • Information on entries in the insolvency register of the local court in whose district the applicant had a place of residence or a commercial establishment in the last three years (§ 26 InsO)
    • Certificate in tax matters from the competent tax office
    • • Protocol of the acceptance of the building inspectorate • Floor plan of the company (scale 1:100) from the location and spatial design of the company
    • are sufficiently apparent. In addition to the operating rooms, this also includes all ancillary rooms and rooms for the staff.
    • Permission to set up slot machines, in accordance with § 33 c (1) GewO
       
    • Application of a legal entity (e.g. GmbH, AG):
    • Application form (completed and signed)
    • (in the case of legal entities with several legal representatives, the personal details of the representatives must be provided on a leaflet)
    • Information from the Central Trade Register for submission to an authority (GZR)
    • This information must be requested from the responsible trade office under the reference: 0401-III-3214-09 03/A and must not be older than three months.
    • Information on entries in the list of debtors until 31.12.2012 (§ 915a ZPO old law)
    • To be applied for at the district court of the main commercial establishment at this time.
    • Information on entries in the Central Register of Debtors of the Central Enforcement Court

    • Information on entries in the insolvency register of the local court in whose district the applicant had a main commercial establishment in the last three years (§ 26 InsO)
    • Certificate in tax matters from the competent tax office
    • Protocol of the acceptance of the building inspectorate Floor plan of the company (scale 1:100) from which the location and spatial design of the company are sufficiently apparent. In addition to the operating rooms, this also includes all ancillary rooms and rooms for the staff.

    • Shareholders' agreement for companies in formation (previous companies)
    • For each managing director or all authorized representatives according to law, articles of association or shareholders' agreement, additionally:
    • Certificate of good conduct and information from the Central Trade Register for submission to an authority (GZR) document type "O"
    • This information must be requested from the residents' registration office responsible for the place of residence under the reference: 0401-III-3214-09 03/A and must not be older than three months.

  • Fees

    • Permission according to § 33i GewO
    • Administrative fee for the permit: between EUR 255.60 and EUR 2,046.00 (Ordinance on Administrative Fees in the Portfolio of the Minister for Economic Affairs and Energy [MWE-GebO], Section 2.2.2.3 et seq.).
    • Certificate of good conduct: 13,00 Euro
    • Excerpt from the Central Trade Register: 13,00 Euro
    • Permission according to § 2 BbgSpielhG
    • Administrative fee for the permit: EUR 2,500.00 (§ 2 paragraph 3 sentence 2 BbgSpielhG)
  • Responsible authority

    The competent authority for the permit according to § 33i of the Industrial Code are the local regulatory authorities (§ 1 paragraph 1 of the Ordinance on Responsibilities in Trade Law [Trade Law Jurisdiction Ordinance - GewRZV])

    The competent authority for the licence under the Brandenburg Gambling Hall Act is also the local regulatory authorities (§ 9 paragraph 1 BbgSpielhG).

    The tasks of the local regulatory authorities are performed by the offices, the municipalities, the municipalities, the municipalities that co-administer the municipalities and the independent cities (§ 3 of the Regulatory Authorities Act – OBG)
