Detailed description
The amount of the minimum wage is adjusted at regular intervals. A permanent minimum wage commission decides on the adjustment every two years.
The decision of the Minimum Wage Commission can be made binding for all employers and employees by ordinance of the Federal Government.In setting the minimum wage, the Commission is guided by collective bargaining developments in Germany. The law stipulates that the minimum wage can be adjusted every 2 years from 2017.
- Since 01.01.2017: EUR 8,84.
- From 01.01.2019: EUR 9,19.
- From 01.01.2020: EUR 9,35.
The Minimum Wage Commission takes various aspects into account when making its adjustment decision. In an overall assessment, it examines whether:
- the new minimum wage is suitable to ensure minimum protection for workers,
- to enable fair and functioning conditions of competition, and
- Employment should not be jeopardised.
In addition, it is based on the development of tariffs when setting it. As soon as the Second Minimum Wage Adjustment Ordinance has entered into force, every worker has the right to have his or her wages paid in the amount of the gross salary laid down in the Ordinance. This applies to each hour actually worked.

Process
The Minimum Wage Commission meets at regular intervals to consider an adjustment of the minimum wage.
- In doing so, it takes into account various aspects and
- give reasons for its decision in writing.
- After a specified period of time, the adjustment shall enter into force.

Deadline
The first adjustment of the minimum wage took effect from 1January 2017. From this point on, the Minimum Wage Commission has to decide every 2 years on the adjustment of the minimum wage.
