  • Detailed description

    If you want to work independently without a German branch, but with a branch in a contracting state (EU member, EEA contracting state or Switzerland) temporarily practice a craft in Germany that is subject to licensing here, then you must report your intention to the Chamber of Crafts, which is responsible for the place where you want to carry out the activity for the first time in Germany, before starting the activity. Is it a self-employed activity as a bricklayer and concrete builder, stove and air heating engineer, carpenter, roofer, road builder, heat, cold and sound insulation insulator. Fountain builder, stonemason and stone sculptor, plasterer. Painters and varnishers, scaffolders, metal workers, surgical mechanics, body and vehicle builders, precision mechanics, two-wheeler mechanics, refrigeration system engineers, information technicians, motor vehicle technicians, agricultural machinery mechanics, gunsmiths, plumbers, plumbers and heating engineers, electrical engineers, electrical machine builders, carpenters, boat and ship builders, rope makers, bakers, confectioners, butchers, hairdressers, glaziers, glassblowers and glass apparatus builders, mechanics for tire and Vulcanization technology, it is sufficient to prove that you are legally established in your country of origin for the purpose of carrying out comparable activities. In addition, proof of at least one year of full-time work or correspondingly longer part-time work within the last ten years is required if the other country of origin does not require a specific professional qualification to carry out the activities in question and you do not have any regulated training for the activities.

    Regulated training is training aimed at the pursuit of a specific profession and consisting of one or more completed training courses, supplemented, where appropriate, by a professional traineeship or professional practice, the structure and level of which are determined by laws, regulations or administrative provisions or must be controlled or approved by an authority designated for control and approval.

    You want to work independently as a chimney sweep, optician, audiologist, orthopaedic technician, orthopaedic shoemaker, dental technician temporarily in Germany without a German branch, but with a branch in a contracting state (EU member, EEA contracting state or Switzerland). In this case, the competent authority must check your professional qualification before providing the service if, taking into account the intended activity, there would be a serious risk to the health or safety of the recipients of the service in the event of insufficient qualifications.

  • Requirements

    In order to take up a temporary cross-border activity in a craft subject to authorisation, it is sufficient to notify the intention in advance with proof of legal establishment in the country of origin if the profession also requires a certain qualification there. This applies to the trades of bricklayers and concrete builders, stove and air heating engineers, carpenters, roofers, road builders, heat, cold and sound insulation specialists. Well builders, stonemasons and stone sculptors, plasterers, painters and varnishers, scaffolding builders, metal workers, surgical mechanics, body and vehicle builders, precision mechanics, two-wheeler mechanics, refrigeration system builders, information technicians, motor vehicle technicians, agricultural machinery mechanics, gunsmiths, plumbers, plumbers and heating engineers, electrical engineers, electrical machine builders, carpenters, boat and shipbuilders, rope makers, bakers, confectioners, butchers, hairdressers, glaziers, glassblowers and Glass apparatus manufacturer and mechanic for tire and vulcanization technology.

    If access to the profession in your country of origin is not linked to a qualification, you can prove that you have completed regulated training.

    If you do not have a regulated training, proof of activity in the selected craft in the last ten years is required to the extent of one year in the case of full-time employment, i.e. correspondingly longer in the case of part-time employment.

    In the trades of chimney sweeps, opticians, audiologists, orthopaedic technicians, orthopaedic shoemakers, dental technicians, the competent authority decides whether an examination of the qualification is required.

    if applicable, on the exercise of the profession to the extent of one year in the case of full-time employment within the last ten years.

  • Process

    Service provider notifies the competent Chamber of Crafts of the intention to provide services in a craft subject to approval.

    The competent chamber examines the existence of a craft subject to approval. It examines whether the practice is regulated in the country of origin. It checks whether the service provider is established in the country of origin to provide the service, i.e. whether it is entitled and acts accordingly.

    If the craft is not regulated in the country of origin, the competent authority shall check whether the activity is subject to regulated training and whether the service provider has successfully completed or is claiming it, and shall provide evidence of the activity for at least one year in the last ten years in the case of full-time or proportionately more in the case of part-time work.

  • Duration

    Within one month: acknowledgment of receipt confirming the immediate eligibility to work or the result of the examination indicating whether an examination of the professional qualification is taking place.

    Within a further month: decision on the verification of the professional qualification

    Within two months in the event of delays that must be justified.

    One month for the opportunity to take an aptitude test if necessary.

  • Deadline

    The notification must be made before the first action. If the intention persists, it must be repeated informally every 12 months.
