Preliminary building permit

With a preliminary decision, individual questions about planned construction projects can be clarified before the start of a building permit procedure at the lower building supervisory authority.

    Before submitting a building application, a preliminary building inquiry can be used to request information in advance on questions that would otherwise have to be clarified in the later building permit procedure.

    A preliminary planning application (application for a preliminary decision) can be useful if it is unclear whether a plot of land can be built on at all according to the applicable building planning law. A preliminary building inquiry can save financial expenses, as not all the documents required for a building permit are necessary. In addition, the builder receives certainty about the buildability of a plot of land at an early stage.

  • Requirements

    The questions must be open to independent assessment.

  • Documents

    In addition to the application form, the following documents must be submitted

    • Site plan or excerpt from the parcel map,
    • Description of the project and
    • the building documents necessary for the assessment of the question posed
  • Fees

    Answering individual questions about building regulations 200-3000€; Answer to the question on the admissibility under planning law 400-15000€.

  • Process

    The preliminary decision is applied for with the building application form by selecting "Application for preliminary decision" in the header of the application.

  • Duration

    approx. 3 months after completion of the documents

  • Deadline

    The preliminary decision is valid for six years, or corresponds to the period of validity of the underlying planning approval decision and binds the building permit authority to the statements made in the preliminary decision for this period.
