Without prejudice to paragraph 4, the transfer of data from the register of craftsmen to non-public bodies in the form of a list is permitted if it is necessary to fulfill the tasks of the Chamber of Crafts or if the person requesting information credibly demonstrates a legitimate interest in knowing the data to be transferred and there is no reason to assume that the person concerned has an interest worthy of protection in the exclusion of the transfer. Such a reason does not exist if the first name and surname of the business owner or the legal representative or the business manager or the personally liable partner responsible for the technical management of the business, the company name, the trade practiced or the address of the commercial establishment are transmitted. The transmission of data in accordance with sentences 2 and 3 is not permitted if the trader has objected. The trader must be informed of the possibility to object in writing or electronically before the first transmission. Excluded from data transmission are the residential addresses of business owners and managers as well as their electronic contact details, e.g. email address, website, fax number, telephone number.

Upon request, data from the Register of Craftsmen shall be transmitted to public authorities if knowledge of the actual or legal circumstances of the owner of a business in a craft requiring a license (Section 1 (1)) is necessary for the performance of their duties.

The recipient may only process or use the transmitted data for the purpose for which it was transmitted.

In accordance with Section 113 (4) sentence 1 HwO in conjunction with the fee regulations of the relevant Chamber of Skilled Crafts, fees are charged for the transmission of data in accordance with the fee schedule of the respective Chamber of Skilled Crafts.

Upon your request, the existence of the requirements will be checked and the transfer will be made.
