The time from 10:00 p.m. to 6:00 a.m. is set as a night's rest period in Germany. During this time, activities that can lead to a disturbance of the night's sleep are prohibited.

However, this prohibition does not apply

• measures to prevent or remedy an emergency, and
• for installations operated on the basis of special permits and for harvesting and tilling work between 5:00 a.m. and 6:00 a.m. and between 10:00 p.m. and 11:00 p.m.
• For outdoor catering in certain cases

In addition, the competent body may, upon request, grant exemptions from the prohibition. These apply if the exercise of the activity during night time is in the public interest or is in the special interest of a party involved. The exemption is to be granted or subject to conditions in order to protect the neighbourhood and the general public from noise under certain conditions. Such exemptions may be permitted by regulatory ordinance for the night from 31 December to 1 January and for trade fairs, markets, folk festivals and similar events as well as for outdoor catering. As a rule, there is a public need if an event serves to cultivate historical or cultural customs or is otherwise of particular municipal importance.
