Second State Examination in Law

The acceptance of the second state examination in law forms the completion of the training of the legal preparatory service. It is divided into a written and an oral part of the examination.

  • Detailed description

    The implementation of the second state examination in law forms the conclusion of the training of the legal preparatory service and is intended to show whether you have the qualification for the office of judge and the higher general administrative service.

    The second state examination in law is prepared and conducted by the Joint Legal Examination Office of the States of Berlin and Brandenburg (GJPA).

    The second state examination in law is divided into a written and an oral part of the examination. The subject of the examinations are the compulsory subjects specified in § 17 (2) in connection with § 3 (2) sentence 1 BbgJAG and the contents of the training in the compulsory stations of the legal preparatory service. Successful completion of the written examination is a prerequisite for admission to the oral examination.

    As part of the written part of the examination, seven supervisory tasks are to be carried out on seven working days with tasks on civil law, criminal law and public law. The work is carried out under supervision with a processing time of five hours each.

    To pass the written exam, you must:

    • achieve at least a point average of 3.50 points and have received at least four points in at least four supervisory work, or
    • have achieved at least a point average of 4.00 points and have received at least four points in at least three supervisory work.

    The oral examination consists of a ten-minute lecture, a five-minute in-depth interview and an examination interview in three sections. Each section relates to a compulsory subject. The duration of the oral examination should be about 45 minutes. Four individual grades are awarded for the oral examination.

    Following the oral examination, the examination board discusses the assessment and informs the examinee of the result with the final number from the written and oral examination. The certificate of the second state examination in law provides information about the passing and the final number of the examination.

  • Requirements

    Admission to the legal preparatory service

    The requirements for the admission, implementation and grading of the second state examination in law are regulated in §§ 16 to 18 BbgJAG in conjunction with §§ 27 to 33 BbgJAO.

    Please note that the legal preparatory service is the responsibility of the Brandenburg Higher Regional Court and is prepared and carried out by it.

    The second state examination in law is divided into the following procedural steps:

    1. The written examination takes place in the 20th month of the training of the legal preparatory service. You will receive the invitation to the written examination by a simple letter about three to four weeks before the exam date.
    2. The second state examination in law consists of a written and an oral part. You must pass the written part of the examination in order to be admitted to the oral part of the examination.
    3. Seven supervisory work has to be carried out for the written part. The work is carried out under supervision with a respective processing time of five hours on seven working days.
    4. To pass the written exam, you must:
    • achieve at least a point average of 3.50 points and have received at least four points in at least four supervisory work, or
    • have achieved at least a point average of 4.00 points and have received at least four points in at least three supervisory work.
    1. The oral examination consists of a ten-minute lecture, a five-minute in-depth interview and an examination interview in three sections. Each section relates to a compulsory subject. The duration of the oral examination should be about 45 minutes.
    2. If you have failed the second state examination in law, you can repeat it once.

    The written examination takes place in the 20th month of training as part of the legal preparatory service. You will receive the invitation to the written examination by a simple letter about three to four weeks before the exam date.
