  • Detailed description

    According to § 1 paragraph 2 KitaG, every child has a legal right to upbringing, education, care and care in day-care centres upon completion of the first year of life and until transfer to the fifth grade, which can also be fulfilled in accordance with paragraph 4. Children up to the age of one and children in the fifth and sixth grades have a legal right if their family situation, in particular employment, absence from home due to job search, education and training of their parents or special educational needs require day care. Children up to the age of one should continue to be cared for to the extent of the minimum care period even after the eligibility requirements have ceased to apply. According to § 1 (3) KitaG, every child from the age of one has a legal right to a childcare service with a minimum childcare time of six hours a day and children of primary school age with a minimum childcare time of four hours. Longer periods of care are to be guaranteed if the child's family situation, in particular employment, absence from home due to the search for employment, the education and training of the parents or a special educational need makes this necessary. In the event of changing daily needs, weekly quotas are to be granted. According to § 1 para. 4 KitaG, other services such as child day care, play groups, all-day school offers and child day care may also meet needs for children up to the age of three and for children of primary school age. The legal obligation is the local public youth welfare agency.

  • Fees

    In principle, the legal claim check does not incur any chargeable costs. If a specific childcare service is used, the facility provider may demand contributions to the operating costs of the facilities (parental contributions) and a subsidy for the provision of lunch for the child in the amount of the average saved own expenses (meal allowance) in accordance with § 17 KitaG. According to § 17a (1) KitaG, the use of a childcare service is free of charge in the last year of daycare before school enrolment and in the cases of § 17 (1a) KitaG (transfer recipients or low-income earners). The exemption from contributions does not include the meal allowance and the use of services that significantly exceed the local framework.
