Writing a property in the land register
You are the owner of several plots of land and would like them to be entered in the land register as a single plot of land.
Your responsible authority
-
Detailed description
Are you the owner of several plots of land and would like them to be entered in the land register as a single plot of land?
You can achieve this by applying to the land registry for one plot of land to be added to the other (main plot of land).
This creates a uniform new plot of land from previously independent plots of land, which in some cases can be used more sensibly from an economic point of view.
-
Requirements
- Existence of several plots of land or rights equivalent to real property
- Publicly certified application of the owner of the plots of land involved.
- A plot of land should only be attributed to another plot of land as a constituent part if there is no reason to fear confusion from this.
This means that, for example, due to different encumbrances on the plots of land, the entries can become confusing and difficult to understand. The legal status of the land must always be clearly recognisable. - The properties involved should be immediately adjacent to each other in the same land register and cadastral district.
- The owner must be pre-registered.
-
Documents
- Application in publicly certified form, as it simultaneously contains the authorisation pursuant to § 19 GBO, with designation of the properties involved
-
Fees
50,00 € according to No. 3 KV No. 14160 Annex 1 GNotKG
-
Process
If the requirements are met, the land registry enters the attribution in the land register.
-
Responsible authority
The land registry of the district court in whose jurisdiction the property is located is responsible.
- Legal basis
-
Pointer
The connected properties lose their independence.
The properties are entered in the land register as one property.
Encumbrances on the main property automatically extend to the ascribed property.
Encumbrances on the ascribed property do not extend to the main property.
