Requesting entry into geographical areas with drones

There are many ways in which drones can be used. If you also want to fly over geographical areas during operation, you may need to apply for a permit.

  • Detailed description

    Drones are unmanned aerial vehicles which, together with the remote control, form an "Unmanned Aircraft System" (UAS). They offer you a wide range of possible applications, for example in the field of photography and videography, for rescuing fawns or surveying areas.

    When operating a drone, you may also want to fly over geographical areas for which you require a permit. A geographical (UAS) area is a part of the airspace defined by the competent aviation authority that permits, restricts or excludes UAS operation. This is intended to avoid risks to

    • public safety,
    • the protection of privacy and personal data or
    • the environment.

    Geographical (UAS) areas that apply nationwide are, for example

    • Federal highways,
    • federal waterways or
    • residential properties.

    Do you want to fly over a geographical (UAS) area but are unable to obtain permission from the operator or the responsible authority? For example, do you want to operate your aircraft near airports or over residential properties without consent and at an altitude of less than 100 meters?
    If you have a legitimate interest in doing so, you can obtain a permit to fly in geographical (UAS) areas from the relevant state aviation authority.

    • required proof of competence
    • intended operation and use of the airspace do not
      • a danger to the safety of air traffic or
      • a risk to public safety and order, in particular violations of data protection and nature and environmental protection
  • Documents
    • Application to fly into a geographical UAS area
    • Proof of air liability insurance
    • if applicable:
      • Proof of competence A1/A3 or proof of competence A2 (remote pilot certificate A2)
      • Self-declaration of practical skills
      • site plan
      • Written consent from the owner of the property
      • Order from affected authorities, agencies or operators
      • Approval from German air traffic control
      • SORA risk assessment (SORA - Specific Operations Risk Assessment) with a detailed description of operations (ConOps)
      • Expert opinion on the suitability of the terrain and affected airspace
      • Further assessments and expert opinions, for example in the area of noise and nature conservation

    State of Brandenburg:

    The application for an individual permit shall consist of the following documents:

    • - detailed map or aerial photographs showing the planned flight sector and the take-off and landing sites,
    • - Proof of sufficient liability insurance for personal injury and property damage in accordance with §§ 37 paragraph 1 letter a, 43 of the German Aviation Act (LuftVG) in conjunction with § 101 et seq. of the Aviation Licensing Regulations (LuftVZO),
    • - Proof of the competence of the remote pilot required by EU law
    • - Transit permit from the Federal Supervisory Authority for Air Navigation Services (for flight operations in restricted areas) and
    • - Operating licence, provided that the operation takes place in the "special" operating category

    The Berlin-Brandenburg Aviation Authority also has the right to request the following evidence and information, among others:

    • - Written consent of the respective property owner or authorized user upon take-off and/or landing on a property
    • - Special use permit from the responsible district office for take-off or landing on public property in Berlin
    • - in Brandenburg, written consent of the competent regulatory authority
    • - in the case of natural persons: copy of identity card or registration certificate, business registration; if applicable, proof of freelance work,
    • - in the case of legal entities and companies under commercial law: an extract from the register of associations, trade or cooperatives as proof of the legal power of representation,
    • - Proof of successful participation of the controller in an instruction/training in the operating system by the manufacturer, alternatively self-disclosure regarding experience in dealing with model airplanes/model helicopters,
    • - Technical details/evidence of the unmanned aerial vehicle and

    - Proof of safety measures to maintain distances from uninvolved persons.

      • Berlin and Brandenburg EUR 300.00
    • Individual geographical permit:
      • private: 65.00 €
      • Commercial: 80.00 €
      • additional effort: discretion
      • further geozone + 20,00 € (in Berlin)
    • Operating license: depending on the amount of testing required, from EUR 200.00
