  • Detailed description

    Building encumbrances are declarations of obligation under public law with which the respective property owners undertake to act, tolerate or refrain from doing anything on their property. This enables the buildability or expansion of the usability of another property. Typical building loads are the road construction load, the distance area construction load and the unification building load, by which several parcels are combined to form a uniform building plot.

    As a rule, the declaration of building encumbrance therefore encumbrances one property in favour of another property.

    The list of building encumbrances shows for which properties there are restrictions under public law on the use of land.

  • Requirements

    Consent of all property owners or Property ownerinside by personal signature.

  • Documents

    The corresponding declaration of commitment for the required construction load is provided by the lower building supervisory authority.

    Registration of a building load 200-2000€

    Deletion of a construction load 100-500€

  • Process

    The signature on a building load declaration must be made in person at the building supervisory authority or be publicly certified.

    The building encumbrance becomes legally effective with the entry in the register of building encumbrances and can only be deleted again if the reason for the entry no longer exists (e.g. the building for which a distance construction encumbrance was entered has been demolished).

    In individual cases, the processing time depends on the degree of difficulty of documenting the construction load and the time window of the parties involved.

    Until the introduction of the building encumbrances in 2016, the legal protection of obligations was carried out by means of limited personal easements, which remain valid.
