Method of proof under waste law

You can apply for proof of disposal for the federal states of Brandenburg and Berlin from SBB Sonderabfallgesellschaft Brandenburg/Berlin mbH.

  • Detailed description

    Hazardous waste

    Anyone who wants to dispose of hazardous waste as a trader must keep a register or certain proofs and accompanying documents.

    The register or the evidence to be kept documents the disposal processes of the hazardous waste. The obligation to keep the register applies to producers, owners, collectors, carriers, dealers and brokers as well as all disposal companies of hazardous waste.

    The obligation to provide evidence applies to the same group of persons with the exception of dealers and brokers of hazardous waste.

    Non-hazardous waste

    For certain non-hazardous wastes, the verification is regulated by regulation or the competent authority can order that registers or proof of the whereabouts of non-hazardous waste must also be kept.

    In any case, waste disposal companies must also keep a register of the disposal of non-hazardous waste.

    Form of verification

    As a rule, registers and records of hazardous waste must be kept in electronic form; only in the case of the keeping of registers on the disposal of non-hazardous waste is the electronic form exempted.


    These obligations do not apply to private households.

  • Requirements

    Only commercial producers of hazardous waste require proof of disposal.

    ATTENTION: in the states of Brandenburg and Berlin there is also an obligation to service hazardous waste!

  • Documents

  • Fees

    Fees are charged according to the disposal proof fee regulations of the states of Brandenburg and Berlin. The main subheadings are:

    • Preparation of a confirmation of proof

    Further fees are levied within the framework of the parallel hazardous waste disposal regulations

  • Process

    Since 01.04.2010, the verification procedure has to be carried out exclusively electronically (online) on a legal basis. As a rule, you need suitable special software for this. Alternatively, there is a possibility via the online portal https://leanv.zks-abfall.de/LaenderEANV_Web .

    The individual process steps are:

    • Applying for an electronic mailbox
    • Completion of the proof application (waste producers and waste disposal companies)
    • Online forwarding of the application to the competent authority
    • The authority decides on your application and answers it with an online notification
    • Upon receipt of the approval notice, waste producers, carriers and disposal companies must keep a delivery note (consignment note) online for each individual disposal. This will be sent online to the competent authority after disposal

    All documents are stored in the register of the companies involved in the disposal

  • Duration

    According to the Proof Ordinance, a maximum of 30 calendar days

  • Deadline

    An approved proof of disposal is valid for a maximum of 5 years.

  • Responsible authority

    Responsible in the state of Brandenburg are the lower waste management authorities of the districts and district-free cities.
