  • Detailed description

    A need for the acquisition and possession of single-shot long guns and up to three repeating long guns as well as the ammunition intended for this purpose is recognized in the case of members of an association carrying weapons for the maintenance of customs (traditional marksmen) if they credibly demonstrate by means of a certificate from the Customs Shooting Association that they need these weapons for the maintenance of customs.

    For events at which it is customary to carry weapons on a special occasion, the exemption permit to carry firearms referred to in subsection (1) sentence 1 as well as other weapons required for the maintenance of customs within the meaning of § 1 para. 2 no. 2 may be granted to a responsible head of the Customs Shooting Association for a period of five years under the conditions of § 42 para. 2, if it is ensured that the necessary care is taken.

    Permission to shoot with the firearms referred to in subsection (1) sentence 1 outside shooting ranges with cartridge ammunition at events referred to in subsection (2) may be granted for a period of five years to a responsible head of the Customs Shooting Association. It shall fail if:

    1. in whose person a requirement pursuant to § 4 para. 1 nos. 1 to 4 is not met,

    2. the observance of the necessary care is not guaranteed,

    3. dangers or significant disadvantages for individuals or the general community are to be feared and cannot be prevented by conditions, or

    4. no liability insurance cover in accordance with § 4 para. 1 no. 5 is proven.

    The permit pursuant to sentence 1 may be combined with the exemption pursuant to subsection (2).

    In the cases of subsections (2) and (3) or in the case of an exemption permit pursuant to § 42 (2), traditional marksmen may carry and shoot firearms without permission. They may also use the firearms required for the maintenance of customs in connection with events at which it is customary to carry weapons on special occasions for which a permit is required under paragraph 2 or §? 42 para. 2 without permission.
