  • Detailed description

    Section 28 shall apply accordingly to the acquisition, possession and carrying of firearms and ammunition by security companies and their security personnel for security tasks in accordance with Section 31(1) of the German Industrial Code on seagoing vessels flying the German flag. By way of derogation from Section 28 (1), a need for such guarding tasks shall be recognized for guarding companies that are licensed in accordance with Section 31 (1) of the German Industrial Code. By way of derogation from Section 28 (3), the license shall be granted subject to conditions that oblige the company to

    1. to only employ persons as security personnel who fulfill the requirements of § 4 paragraph 1 numbers 1 to 3,

    2. to name the persons employed to the competent authority within a period determined by the authority and

    3. to submit evidence at the request of the competent authority that proves that the persons employed meet the requirements of § 4 paragraph 1 numbers 1 to 3.

    The permit shall be limited to the duration of the license in accordance with Section 31 of the Trade Regulation Act. It may be extended. The extension of the permit shall be refused in particular if the requirements under paragraph 1 sentence 3 have not been complied with. In all other respects, the general provisions of this Act shall apply. The permit shall include permission to bring on board in accordance with Section 29 (1).

    The applicant must have reached the age of 18, have the required reliability and personal suitability, the required expertise, a need and liability insurance of 1 million euros - lump sum for personal injury and property damage.
