  • Detailed description

    Section 28 shall apply mutatis mutandis to the acquisition, possession and carrying of firearms and ammunition by security companies and their guarding personnel for guarding tasks pursuant to § 31 (1) of the Industrial Code on seagoing vessels flying the federal flag. By way of derogation from § 28 (1), a need for such security tasks is recognised by security companies that have a licence in accordance with § 31 (1) of the Industrial Code. By way of derogation from Section 28 (3), the licence shall be granted subject to conditions obliging entrepreneurs to:

    1. to employ only persons who meet the requirements of § 4 (1) numbers 1 to 3 as security personnel,

    2. to designate to the competent authority the persons deployed within a period determined by the authority, and

    3. to submit, at the request of the competent authority, evidence proving that the persons deployed meet the requirements of § 4 (1) numbers 1 to 3.

    The permit is to be limited to the duration of the approval in accordance with § 31 of the Industrial Code. It can be extended. The extension of the licence shall be refused in particular if the conditions under subsection (1) sentence 3 have not been complied with. In all other respects, the general provisions of this Act shall apply. The permit includes the permission to bring on board in accordance with § 29 paragraph 1.

    The applicant must have reached the age of 18, have the necessary reliability and personal suitability, prove the necessary expertise, a need and insurance against liability in the amount of 1 million euros - lump sum for personal injury and property damage.
