  • Detailed description

    If you want to operate a nationwide system for the disposal of sales packaging, you need an official permit.

    According to Section 7 (1) of the Packaging Act (VerpackG), manufacturers of sales packaging filled with goods, which typically accumulate at the private end consumer, are obliged to participate in a system (so-called dual system). This takes over the collection, sorting and recycling of packaging for the obligated parties. The systems shall be set up across the board and shall be subject to approval by the competent authority.

    The authorisation may subsequently be accompanied by ancillary provisions necessary to ensure that the conditions met at the time of the declaration are met on a permanent basis during the operation of the system.

    After approval has been granted, you must ensure the regular collection of used, completely empty sales packaging from the private end consumer or in his vicinity in a sufficient manner throughout the specific catchment area free of charge. You must recycle the packaging recorded in your collection system in accordance with the legal requirements. Multiple systems can work together to set up and operate their systems.

    Pursuant to § 8.1 of the Packaging Act, the obligation to participate in a dual system may be waived if manufacturers and distributors of sales packaging deliver to sources of waste which are treated in the same way as private households under § 3.11 of the Packaging Act and organise their own collection of their packaging at these points of generation. The operators of these so-called industry solutions must notify the competent authority of their activities.

  • Process

    An application for system approval is submitted. The application must be submitted to the State Office for the Environment of the State of Brandenburg.

    Once the application documents have been completed, the final processing of the application takes place.

    The applicant will receive a system approval or rejection notice.

    An authorisation shall be made public by the competent authority.

    The processing time is not regulated by law. It depends on the scope of the procedure.
