- Protection of trees as "protected landscape features"
Trees can be protected by the federal states through tree protection ordinances or statutes as so-called "protected landscape features" (Section 29 of the Federal Nature Conservation Act). This is mainly used for built-up areas.
In addition, the federal states can also place avenues under protection (Section 29 of the Federal Nature Conservation Act).
The specific content and procedure depend exclusively on the law of the respective federal state.
- Protection of trees for reasons of species conservation
It is generally prohibited to cut down or uproot trees and other woody plants in the period from March 1 to September 30. During this period, only careful shaping and pruning to remove the growth of plants or to maintain the health of trees is permitted (Section 39 of the Federal Nature Conservation Act). Exceptions to this can be granted, for example, to ensure traffic safety.
The form and procedure for submitting an application are also determined exclusively by the law of the respective federal state.
