Detailed description
A need to acquire, possess and carry firearms is recognised in the case of a security contractor (§ 34a of the Industrial Code) if he credibly demonstrates that security orders are or are to be carried out which require firearms for reasons of securing an endangered person within the meaning of § 19 or an endangered object. Sentence 1 shall apply mutatis mutandis to security services as part of economic undertakings. A need credibly demonstrated in accordance with sentences 1 and 2 also includes the acquisition and possession of the ammunition intended for the firearms referred to therein.
The firearm may only be carried when a specific order is actually carried out in accordance with paragraph 1. The contractor must also ensure this in an appropriate manner with his security personnel.
Guards who, on the basis of an employment relationship, are to possess or carry firearms of the licence holder in accordance with the latter's instructions shall be designated by the competent authority for examination; the operator should inform the security guard concerned in an appropriate manner beforehand of the designation, with reference to the necessity of the processing of personal data at the authority. Firearms or ammunition may not be surrendered until the competent authority has given its consent. Consent is to be refused if the guard does not meet the requirements of §? 4 para. 1 nos. 1 to 3 or the liability insurance of the security company does not cover the risk of handling firearms by the guards.
A firearms licence pursuant to § 10 (4) may also include the addition that the persons referred to in paragraph 3 may carry the weapons provided to them in accordance with the instructions of the licence holder.

The applicant must have reached the age of 18, have the necessary reliability and personal suitability, prove the necessary expertise, a need and insurance against liability in the amount of 1 million euros - lump sum for personal injury and property damage.
