Checking the reliability of traders in industries requiring monitoring

Anyone registering or re-registering a trade that requires monitoring will have their reliability checked by the trade authority on the basis of a certificate of good conduct for submission to an authority and information from the trade central register for submission to an authority.

  • Detailed description

    In the case of the following trades, the Trade Licensing Office must check the trader's reliability immediately after the trade registration or re-registration has been submitted:

    • Purchase and sale (second-hand goods trade) of
      • high-value consumer goods, in particular consumer electronics, computers, cameras, video cameras, carpets, fur and leather clothing
      • motor vehicles and bicycles
      • precious metals and alloys containing precious metals or corresponding goods
      • precious stones, pearls and jewelry
      • scrap metals
    • credit agencies, detective agencies
    • Arranging marriages, partnerships and acquaintanceships
    • Operation of travel agencies and mediation of accommodations
    • Locksmith services, distribution and installation of building security devices
    • Production and distribution of special theft-related opening tools
  • Requirements

    Registration or re-registration of a trade requiring supervision

  • Documents
    • Certificate of good conduct for submission to an authority
      • in the case of natural persons, for the trader(s)
      • in the case of partnerships, for each managing partner
      • for legal entities for each legal representative
    • extract from the commercial register for submission to an authority
      • for natural persons for the trader(s)
      • in the case of partnerships, for each managing partner
      • for each legal representative in the case of legal entities

  • Process

    1. register your register or convert a trade that requires monitoring.

    2. apply for a certificate of good conduct for submission to an authority and information from the central commercial register for submission to an authority and submit it to the trade authority.

    3. The trade authority checks your reliability.

    Immediately after registration or re-registration of a trade requiring monitoring

  • Responsible authority

    The trade offices of the offices, municipalities without administrative authority, association municipalities, co-administering municipalities, co-administered municipalities and independent cities are responsible, § 1 paragraph 1 of the Ordinance on Responsibilities in Trade Law (Trade Law Competence Ordinance – GewRZV).
