  • Detailed description

    You can cancel or change the legal matrimonial property regime of community of gains by means of a marriage contract. For this purpose, please seek advice from a notary. The notary must certify your marriage contract in the simultaneous presence of both spouses. You can have the agreed matrimonial property regime of separation of property or community of property or its cancellation entered in the matrimonial property registry. Furthermore, you can limit or exclude your spouse's authority to transact business with effect for you. The application must be made by you and your spouse in notarised form. Registration is necessary so that others take note of your matrimonial property regime and the arrangements you have made.

  • Requirements

    You have concluded a marriage contract with a notary because you wish to cancel or change the legal matrimonial property regime of community of gains. Your chosen matrimonial property regime can be registered if you

    • apply for registration in notarised form at the register of matrimonial property regimes and
    • present the notarised marriage contract.

  • Fees

    • Notary costs: The costs for the notarisation of the marriage contract and the registration by a notary are determined in each case according to the current assets of both spouses. (§ 100 German Law on Court and Notary Fees (GNotKG)).
    • Court fees: Fee for the entry in the register of matrimonial property rights: fee of € 100 (no. 13200 KV GNotKG).
    • Costs for the publication of the entry in the newspaper
