Property in the land register Derecognition

Each plot of land is shown in the land register in a special place on a separate land register page. As a rule, land is subject to compulsory entry in the land register. Certain plots of land are exempt from this obligation.

  • Detailed description

    Each plot of land is shown in the land register in a special place on a separate land register page. As a rule, land is subject to compulsory entry in the land register.

    Certain plots of land are exempt from this obligation, e.g. plots of land belonging to the federal government, the federal states, the municipalities, the churches or public roads.

    A plot of land that is exempt from the obligation to record but is nevertheless entered in the land register can be removed from the land register at the owner's request, i.e. it can be derecognised. This presupposes that there are no encumbrances on the property.

  • Requirements
    • Written application of the owner
    • The (new) owner is exempt from the obligation to make entries in the land register in accordance with Section 3 (2) GBO. These are the federal government, the states, the municipalities and other municipal associations, the churches, monasteries and schools, owners of watercourses, public ways, as well as land which is dedicated to a railway company serving public transport.
    • There are no entries by which the owner's right is affected.
    • The rights in Division II and Division III have been deleted.
  • Documents

    Written request from the owner indicating the land concerned

  • Fees

    No fee is charged for the deregistration.

  • Process

    The land registry's notice of derecognition shall be entered in the land register's inventory. If all the properties entered on a sheet are derecognised, the sheet shall be closed.

  • Responsible authority

    The land registry of the district court in whose jurisdiction the property is located is responsible.
