Municipalities in which the adequate supply of housing to the population is particularly at risk may determine by statute that housing may only be used for purposes other than residential purposes with permission. In some cases, according to the law, it does not require a permit.  

In principle, however, a permit must be granted if overriding public interests or other interests worthy of protection in the preservation of the living space prevail.

In the event of intentional or negligent action, this can be punished with an administrative offence of up to 100,000 euros.
