  • Forms

    State of Brandenburg:

    The Ministry of Agriculture, Environment and Climate Protection provides applicants with the program "Elektronische immissionsschutzrechtliche Antragstellung (ELiA)" free of charge. The program supports the applicant with help texts, key tables, default settings in forms and automatic transfer of entries to subsequent forms to ensure that the application is complete and correct. At the same time, the program is used to prepare the transmission of applications electronically via a virtual mailroom (Governicus Communicator) and thus enables the submission of applications in both electronic and paper-based form.

    In order to standardize the procedure in the immission control approval procedure, the use of the forms generated from ELiA is prescribed for the application in accordance with the ELiA decree of 19.05.2016.

    It is recommended that the applicant contacts the responsible approval authority as early as the project planning phase (pre-application consultation). The earlier the authority is informed, the better it can perform its statutory advisory function.


  • Detailed description

    Due to their nature or operation, installations can cause harmful environmental effects or otherwise endanger, significantly disadvantage or significantly inconvenience the general public or the neighborhood.

    If you want to set up and operate such a facility, you need a permit from the competent authority.

    Stationary waste disposal facilities for the storage or treatment of waste are also subject to approval.

  • Documents

    State of Brandenburg:

    Which forms must be completed for the specific project and which additional documents must be submitted is determined in a binding manner by the approval authority. This can be done in a preliminary meeting. As a rule, plans, flow diagrams and descriptions/explanations of measures and operating methods must be attached to the permit application.

  • Fees

    State of Brandenburg:

    A fee is charged for the decision on a permit application in accordance with the provisions of the Fees Act and the Fee Schedule, even in the event of rejection or discontinuation of the procedure for withdrawn applications. This depends on the construction costs and includes fees for other official acts, e.g. statements by the building authority. Expenses for e.g. publications in daily newspapers, room rental for hearings, but also expert opinions commissioned by the authority are to be reimbursed by the applicant.

  • Process

    The approval procedure requires a written application, which must be accompanied by the drawings, explanations and other documents required to check the approval requirements. If the application is complete, it must be published together with the documents and then displayed for one month. In simplified approval procedures or if public participation is waived, there is no public display and no discussion meeting takes place. At the latest at the same time as the public announcement of the project, the approval authority also requests the authorities to be involved to submit their comments on the approval requirements within one month. If there are any objections, these will be discussed with you and those who have raised the objections at a public meeting. Once the licensing authority has determined all the circumstances that are relevant to the granting of a license, a decision must be made on the application. The approval decision must be substantiated in writing and will be sent to you and the persons who have raised objections. The notification of the approval notice to objectors can be replaced by a public announcement.

  • Duration

    State of Brandenburg:

    A decision on the application for approval must be made within seven months of receipt of the application and the complete documentation to be submitted in formal procedures and within three months in simplified procedures.
