Permission for child day care Granted

If you want to care for one or more children outside the household of the parent or guardian regularly and against payment, you usually need permission to do so.

  • Detailed description

    The permit for child day care according to § 43 of the Eighth Book of the Social Code (SGB VIII), § 20 of the Day Care Center Act of the State of Brandenburg (KitaG) is granted at the request of the child day care person who wants to offer weekly more than 15 hours and more than three months of child day care for remuneration outside the household of the legal guardian during a part of the day, by the youth welfare office of the local youth welfare provider for up to five childcare places. The permit shall indicate the maximum number of day care places. This is based on the requirements of the child's best interests, in particular on the qualification, suitability and performance of the day carer, and on the premises available for day care. When determining the maximum number, children who are cared for during the absence of another day carer in accordance with § 23 paragraph 4 sentence 2 of the Eighth Book of the Social Code are not taken into account if it concerns the temporary care of a few children. If children are cared for only a few hours or on a few days, they may be completely or partially disregarded if the requirements of the child's best interests in accordance with § 20 paragraph 1 sentence 3 KitaG Brandenburg are met. If more than five children are to be cared for, an operating permit is required in accordance with § 45 of the Eighth Book of the Social Code.

    According to § 20 paragraph 5, sentence 2 KitaG Brandenburg, permission is refused if you have been legally convicted of a criminal offence mentioned in § 72a of the Eighth Book of the Social Code.

    Permission for day care for children

    • is provided by the local youth welfare provider (district or district-free city – youth welfare office),
    • is limited to 5 years,
    • may be provided with ancillary provisions,
    • necessary for paid care outside the household of the legal guardian, during part of the day, for more than 15 hours per week and longer than three months
    • in principle, you are entitled to care for up to 5 foreign children present at the same time.
    • Operating permit according to § 45 SGB VIII required for the care of more than five foreign children
    • is refused if there is a final conviction of a crime mentioned in § 72a of the Eighth Book of the Social Code
  • Requirements

    Permission will be granted to you if you are suitable for child day care. According to § 43 paragraph 1 no. 1 and 2 SGB VIII, this is to be assumed if

    • you are distinguished by your personality, expertise and willingness to cooperate with legal guardians and other childcare workers,
    • you have child-friendly premises,
    • You have a good knowledge of the requirements in child day care. You must have acquired this knowledge in qualified courses.
    • You meet the requirements of the Child Day Care Aptitude Ordinance.

    • Detection of measles protection
    • Health certificate (re-proof every 5 years)
    • Proof of qualification as a childcare worker

  • Process

    You can apply for a permit for day care for children at the responsible public youth welfare institution (district or district-free city – youth welfare office), submit the following documents here:

    • Extended police clearance certificate
    • Medical certificate of proof of measles protection and submission of health certificate
    • Details of the premises.

    Afterwards, the child-friendly premises are checked by a joint inspection with the local youth welfare office.

    Before the first child is admitted to day care, the childcare worker must have taken part in a preparatory course of at least 30 hours.

    In addition, the course "First Aid for Infants and Toddlers" must be completed.

    Anyone who cares for two or more foreign children and has no pedagogical training must also have successfully participated in a basic qualification of at least 130 hours. This basic qualification should be carried out as part-time as possible.
