Applying for an extension of the training tolerance

If you are in possession of a tolerated stay permit and your training cannot be completed within the planned period, your tolerated stay permit will be extended for the extension period of your vocational training.

  • Detailed description

    The training toleration permit is generally issued for the duration of the training specified in the training contract. If you can already foresee that you will not be able to complete your training in the planned time, you must apply for an extension of the training toleration.

    An extension may be considered, for example, if you do not pass the final examination.

    The vocational training contract is usually extended until the next repeat examination. The extension will also be entered in the register of vocational training relationships. Upon application, the training toleration will also be extended for the extension period of the vocational training.

    The extension of the training toleration is also required after the successful completion of a state-recognized or comparably regulated assistant or helper training for the period of the subsequent qualified vocational training.

    If the training relationship is terminated prematurely or broken off, the training toleration expires.

    In this case, it depends on whether anything has changed since the initial application for training toleration (including whether the training place commitment for the subsequent training continues and whether it is still a so-called "shortage occupation").

    You may remain in Germany for the duration of the validity of the Ausbildungsduldung and cannot be deported.

  • Requirements
    • You are unable to successfully complete your training, would like to extend it to achieve your training goal or have successfully completed your assistant and helper training.
    • You already have a training place or have the prospect of one.
    • It is a qualified vocational training program.
    • Your identity has been clarified or you have unsuccessfully but demonstrably taken all reasonable measures to clarify your identity.
    • You have no links to extremist or terrorist organizations and do not support them. You have not yet been convicted of a criminal offense. There is no interest in deporting you.
    • If you have not yet reached the age of 18, your legal guardians must consent to your stay in Germany.
  • Documents
    • Recognized identity document (e.g. passport, passport substitute, official ID card with photo, official documents from the country of origin such as military ID, driver's license, consular card, laissez-passer, service card or civil status certificate with photo)
    • Current biometric photo in passport format (45 x 35 mm)
    • For in-company vocational training:
      • Extended vocational training contract
      • Proof of the extension of the entry of the training contract in the register of vocational training relationships (e.g. confirmation of registration or application for registration from the relevant Chamber of Crafts)
    • In the case of school-based training: extended contract of the educational institution with the name of the training occupation
    • In the case of minors: consent of the legal guardians to the planned stay (declaration of consent)
    • The documents and information must always be submitted in German. In individual cases, the Immigration Office may require fewer or additional documents.
  • Fees

    Cost amount (fixed) Fee:

    • 58.00 for the Ausbildungsduldung as an adhesive label
    • 62.00 for the training permit with carrier form

    Remark:

    The foreigners authority may charge a fee for the extension of the training toleration. The time and form in which the fee is charged and paid varies depending on the authority.

    In certain cases, fee reductions or exemptions may be considered (for example, if you cannot earn a living without drawing on public benefits).

  • Process
    • You must apply to extend your training toleration before the validity of your previous training toleration expires.

    • Find out whether your foreigners authority allows you to apply online or has a special application form.

    • If you can only apply in person, make an appointment at the immigration office. If you apply online, the immigration office will contact you after receiving your application to arrange an appointment.

    • During the appointment, your identity and documents will be checked (please bring your documents to the appointment, in the original if possible).

    • If your application is approved, you may be issued with your new tolerated stay permit during the appointment. If your application is rejected, you will receive a notice of rejection. In this case, you will not be allowed to start your training.

  • Duration

    The processing time may vary depending on how busy the Foreigners' Registration Office is. As the Ausbildungsduldung is issued at the Foreigners' Registration Office, it is generally possible to hand it over during the interview.

  • Deadline

    The extension should be applied for in good time before your previous training toleration expires.

    The validity of the Ausbildungsduldung depends on the remaining duration of the training.

    The Ausbildungsduldung will be extended by a maximum of one year if the trainee does not pass the final examination, the training is extended and proof of the next examination date is available.

  • Responsible authority

    The foreigners authority responsible for the applicant's place of residence is responsible for issuing the residence permit.

    The competent authority in the State of Brandenburg is if you

    • live in a town or municipality belonging to a district: the district administration,
    • live in an independent city: the city administration.

    • If you successfully complete your vocational training, you may be eligible for a residence permit for a further two years ("3+2" rule). If you are not taken on by the training company, you will initially be granted a tolerated stay for six months to look for work.
    • If you break off your training contract or terminate it prematurely, your tolerated stay expires. You can receive a one-off tolerated stay for six months to look for a new training place. Training companies and educational institutions are obliged to inform the Immigration Office within two weeks of the termination of your training.
    • You are not allowed to travel abroad with the tolerated stay permit.
    • The "Ausbildungsduldung" expires if you are convicted, if you are deported or if a deportation order is issued against you to prevent a particular danger, especially a terrorist threat.
    • The procedure is usually conducted in German. If you have insufficient knowledge of German, you are advised to speak to a person who can act as a translator.
    • To the best of your knowledge and belief, you must provide the immigration authorities with correct and complete information so that your application can be processed without major delays.
    • If you provide incorrect or incomplete information, this can slow down the procedure and be to your disadvantage. In an emergency, incorrect or incomplete information that you have provided and not completed or corrected in good time to the immigration authority may result in the withdrawal of residence rights that have already been granted, a fine, a prison sentence of up to three years or expulsion from the federal territory.
