Partial approval for the construction of an installation Issue

If you wish to construct and or operate part of a new facility, you must apply for a partial permit from the appropriate authority.

  • Detailed description

    Parts of installations may, due to their nature or operation, cause harmful environmental effects or otherwise endanger, significantly disadvantage or annoy the general public or the neighborhood.

    If you want to erect or operate a plant, you need a partial permit from the competent authority. A partial permit can be applied for and issued if the full permit for an applied-for facility has not yet been issued, but the following conditions are met:

    • There is a legitimate interest in issuing a partial permit,
    • the licensing requirements for the subject of the partial permit applied for are met, and
    • a preliminary assessment shows that there are no a priori insurmountable obstacles to the construction and operation of the entire facility with regard to the permit requirements.
  • Requirements
    • The sub-project meets the requirements of the Federal Immission Control Act.
    • The subproject is not precluded by any other regulations under public law or occupational health and safety issues.
    • A preliminary assessment has shown that there are no a priori insurmountable obstacles to the construction and operation of the entire plant with regard to the permit.
      • The preliminary overall assessment is no longer binding if the factual or legal situation or individual inspections change in the course of subsequent partial approvals, thereby also changing the assessment. In this case, the authority may refuse the approval or further partial approvals.

  • Fees

    A fee is charged for the decision on an application for partial approval in accordance with tariff item 2.1.1 of Annex 2 of the Fee Regulations (GebOMUGV).

  • Process

    The approval procedure requires a written application, which must be accompanied by the drawings, plans, expert opinions and explanations as well as other documents required to check the approval requirements.

    If your application is complete, it must be published together with the documents and then displayed for one month. In simplified approval procedures or if public participation is waived, there is no public display and no discussion meeting.

    At the latest at the same time as the public announcement of the project, the licensing authority shall request the authorities to be involved to submit their comments on the licensing requirements within one month.

    If the approval requirements are met, the authority checks whether there is a legitimate interest in the construction and operation of the sub-project.

    A preliminary assessment will determine whether there are no insurmountable obstacles to the construction and operation of the entire facility with regard to the partial approval requirements.

    You will receive notification of the approval or rejection of the partial project.

  • Duration

    A decision on the application for approval must be made within seven months of receipt of the application and the complete documentation to be submitted in formal procedures and within three months in simplified procedures.

    You must apply for the permit before you start the project.
