Preliminary decision on a plant requiring approval in accordance with BImSchG Issuance

If you apply for a preliminary decision on a plant requiring a permit, the competent authority may grant this under certain conditions.

  • Detailed description

    When you apply for a preliminary decision, the competent authority decides on individual licensing requirements and on the location of the plant.

    Provided that the effects of the planned plant can be sufficiently assessed and there is a justified interest in issuing a preliminary decision, the competent authority shall issue a preliminary decision.

  • Requirements
    • From the application you submit and the required documents, the competent authority must be able to sufficiently assess the impact of the planned plant.
    • Your application must show a legitimate interest in the issuance of a preliminary decision

    • required drawings, plans, expert opinions
    • explanations of the plant
    • other documents (if necessary, ask the competent authority)
  • Fees

    A fee is charged for the decision to grant partial approval in accordance with tariff item 2.1.3 of the Fee Schedule (GebOMUGV).

  • Process

    If you wish to obtain a preliminary decision on an installation requiring approval, you must submit a written application to the responsible authority in advance.
    Enclose the drawings, explanations and the reasoned choice of location required to check the requirements.
    The competent authority will decide whether to issue the preliminary permit.
    You will receive notification of the granting or rejection of the preliminary decision.
    The preliminary decision becomes invalid if you do not apply for approval of the plant within two years. The deadline can be extended to four years on request.
